Agreement to Terms

By accessing or using the Marcus mobile application ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

These Terms of Service constitute a legally binding agreement between you and CET TECH LLC.

Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

License and Access

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Marcus application for your personal, non-commercial use, subject to these Terms.

You agree not to:

• Modify, reverse engineer, or decompile the app
• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any portion of the Service
• Upload or transmit viruses or malicious code
• Interfere with or disrupt the Service

User Accounts

To use certain features, you must register for an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

Third-Party Integrations

Our Service integrates with third-party services including Google, Microsoft, Apple, Slack, and AI service providers. Your use of these integrations is subject to their respective terms of service and privacy policies.

We are not responsible for the practices of these third-party services. You authorize us to access your data from these services as necessary to provide our Service.

AI-Powered Features

Marcus uses artificial intelligence to provide intelligent assistance. While we strive for accuracy, AI-generated content may not always be correct or complete. You should review and verify all AI-generated information before relying on it.

You retain ownership of the data you provide, but you grant us a license to use, process, and analyze your data to provide and improve our AI services.

Intellectual Property

The Service and its original content, features, and functionality are owned by CET TECH LLC and are protected by international copyright, trademark, and other intellectual property laws.

You may not use our trademarks, logos, or branding without our prior written consent.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results obtained will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CET TECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability shall not exceed the amount you paid us in the 12 months prior to the event giving rise to liability.

Indemnification

You agree to indemnify and hold harmless CET TECH LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions that should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
